1. Eligibility and Minor Users

The Platform is designed for high school student-athletes, many of whom are under 18. By creating an account, you confirm that:

• If you are under 13, a parent or legal guardian must register on your behalf and accept these Terms.
• If you are 13–17, a parent or legal guardian must review and agree to these Terms before you create an account.
• If you are a parent or guardian, you accept these Terms on behalf of your minor child and take responsibility for their use of the Platform.
• If you are a college coach or administrator, you are at least 18 years old and are using the Platform for legitimate recruiting purposes only.

2. Your Account

You are granted a personal, non-transferable, non-exclusive license to access and use the Platform. You agree to:

• Provide accurate and current information when creating your account
• Keep your login credentials confidential
• Not share, sell, or transfer your account to anyone else

We reserve the right to suspend or terminate any account that violates these Terms, with or without notice.

3. Acceptable Use

You agree to use the Platform only for lawful purposes and in a manner consistent with its intent — connecting student-athletes with college soccer programs. You may not:

• Post false, misleading, or inaccurate profile information
• Harass, spam, or send unsolicited messages to other users
• Attempt to access, hack, or reverse engineer any part of the Platform
• Use the Platform to violate NCAA, NAIA, NJCAA, or any other governing body's recruiting rules
• Scrape, copy, or redistribute any content from the Platform without our permission

4. Recruiting Profiles and Visibility

By creating a student-athlete profile, you understand and agree that:

• Your profile information — including name, stats, highlight videos, academic information, and contact details — may be visible to verified college coaches as well as the public
• You are responsible for the accuracy of your own profile
• You control what information you include and may update or remove it at any time through your account settings

5. Recruiting Disclaimer

Ninety provides tools to help student-athletes connect with college programs, but we make no guarantees that using the Platform will result in recruitment, scholarship offers, roster spots, or any other outcome. Results depend entirely on individual effort, athletic ability, academic standing, and factors outside our control.

Additionally, it is the responsibility of student-athletes, parents, and coaches to ensure that all recruiting activity complies with the rules of the relevant governing body (NCAA, NAIA, NJCAA, etc.). Ninety is not responsible for any recruiting rule violations.

6. Payments and Subscriptions

Certain features of the Platform require a paid subscription. By subscribing, you agree to:

• Pay all applicable fees at the time of purchase
• Provide accurate billing information
• Allow us to charge your payment method on a recurring basis (if applicable)

All payments are processed securely through Stripe. We do not store your payment card information.

7. Refund Policy

We offer a 7-day money-back guarantee. If you are not satisfied, contact us at [email protected] within 7 days of your original purchase date to request a full refund. Refund requests made after 7 days will not be honored.

8. Intellectual Property

All content, branding, software, graphics, and features on the Platform are the exclusive property of Ninety and/or its licensors. You may not reproduce, modify, distribute, or create derivative works from any Platform content without our prior written permission.

9. Disclaimer of Warranties

The Platform is provided “as is” and “as available.” We make no warranties, express or implied, regarding the accuracy, reliability, or uninterrupted availability of the Platform.

10. Limitation of Liability

To the fullest extent permitted by law, Ninety will not be liable for any indirect, incidental, special, or consequential damages arising from your use of — or inability to use — the Platform, including but not limited to missed recruiting opportunities or reliance on information found on the Platform.

11. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the Platform shall be resolved in a court of competent jurisdiction in the United States.

12. Changes to These Terms

We may update these Terms as the Platform evolves. If we make material changes, we will notify you by email. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
